Legal notice and general terms of use

Preamble
Continued browsing of the www.fauvette-paris.com website (hereinafter referred to as "the Site") implies unreserved acceptance by visitors to the Site (hereinafter referred to as "Users") of the following provisions and conditions of use (hereinafter referred to as "G.C.U."). Prior to any use of the functionalities of our Site, the User acknowledges having read and accepted the present G.U.C..
The current online version of our T.G.U. is the only one applicable during the entire period of use of the Site and until we replace it with a new version.
The Site is managed by SASU FAUVETTE PARIS (hereinafter the "Publisher"), which reserves the right to modify these conditions at any time. Any use of the Site after modification of the T.G.U. implies irrevocable acceptance by the User of the new version. In the event of disagreement with our T.G.U., the User is invited to discontinue use of the Site.
ARTICLE 1 - DEFINITIONS
On the Site, the terms below have the following meaning:
"Content": refers to all the elements constituting the information present on our Site (texts, images, videos, algorithms, software, widgets, etc.) and enabling its operation, the provision of information to the User and the presentation of our services;
"Intellectual Property Rights": refers to all intellectual property rights and related rights (copyright, trademark rights, patent rights, trade names, databases, etc.) as protected by the Intellectual Property Code created by law no. 92-587 of July 1, 1992, the current version of which is that applicable at the time the User consults the Site;
"Publisher": refers to the company FAUVETTE PARIS, SASU with a share capital of 1,000 €, registered with the Paris Trade and Companies Register under number B 851 385 831, having its registered office at 73 Boulevard Soult 75012 Paris, which can be contacted by e-mail at contact@fauvette-paris.com;
"Features": refers to all the functionalities made available to Users via the Site;
"Site": refers to the www.fauvette-paris.com site operated by the Publisher and made available to the User;
"User": refers to any individual using our Site and having access to its content.
ARTICLE 2 - LEGAL NOTICES
Pursuant to French law no. 2004-575 of June 21, 2004 on confidence in the digital economy, users of the Site are informed of the identity of the parties involved in its creation and monitoring:

ARTICLE 3 - PROTECTION OF PERSONAL DATA
In order to use the Site, the Publisher processes certain personal data concerning Users. Such processing is carried out in compliance with the French Data Protection Act no. 78-17 of January 6, 1978, as amended, and with the Data Protection Policy accessible in the corresponding tab on the Site.
ARTICLE 4 - DESCRIPTION OF SERVICES PROVIDED
The Editor endeavours to provide information that is as accurate as possible, but cannot be held responsible for any omissions, inaccuracies or failure to update information. All information provided on the Site is given for information purposes only and is not exhaustive. It is provided subject to any changes that may have been made since it was put online.
ARTICLE 5 - ACCESS TO THE SITE
5.1 General terms and conditions
Access to and use of the Site are reserved for strictly personal use. The User undertakes not to use the Site and the information or data contained therein for commercial, political or advertising purposes, or for any form of commercial solicitation, in particular the sending of unsolicited e-mails.
Users are personally responsible for setting up the IT and telecommunications resources required to access the Site. Telecommunication costs incurred in accessing the Internet and using the Site shall be borne by Users.
5.2 Use of Site services
The Publisher cannot be held liable if a User has provided false personal information when subscribing to the Services.
The User is solely responsible for the accuracy of the information provided when subscribing to the Services. In this respect, he/she undertakes to update the information if necessary. The Publisher shall not be held liable for any truncated, inaccurate or missing data that may have a direct or indirect impact on the use of the Site.
5.3 Account creation
In order to access certain services on the Site and to place an order, the User may create an account. The Account must be created by a User who is at least 18 years of age.
FAUVETTE PARIS shall not be held liable in the event of a User's violation of this provision or if the User has provided false personal information when creating an account.
when creating his/her Account. To create an Account, Users will be asked to define a login and password.
Each User is solely responsible for the security and confidentiality of his/her login information and must notify FAUVETTE PARIS immediately in the event of loss or theft of his/her login information. FAUVETTE PARIS may not be held liable in the event of loss or theft of a User's login information resulting in fraudulent use of the User's Account.
The User is invited to refer to the Site's Personal Data Protection Policy for information on how the User's personal data is processed. The User guarantees that all information entered in his or her Personal Space is accurate, up-to-date and truthful.
The User is solely responsible for the accuracy of the information entered in his/her Personal Space. The User agrees to update the information if necessary. FAUVETTE PARIS may not be held liable in the event of truncated, inaccurate or missing data having a direct or indirect impact on the performance of the Services or on the performance of a service.
Any regularly registered User may also request to be unsubscribed by sending a request via the contact form. Unsubscription will take effect within a reasonable period of time and within a maximum of one (1) month.
ARTICLE 6 - INTELLECTUAL PROPERTY
6.1 The Site
All trademarks, photographs, texts, comments, illustrations, images (animated or not), video sequences, sounds, as well as all computer applications that may be used to operate the Site and, more generally, all elements reproduced or used on the Site are protected by current intellectual property laws.
They are the full and complete property of the Publisher or its commercial partners. Any
reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of the publisher, is strictly prohibited. The fact that the publisher does not initiate proceedings as soon as it becomes aware of such unauthorized use does not imply acceptance of said use and waiver of prosecution.
It is strictly forbidden for the user to :
- Copy, reproduce, represent, disseminate, distribute or publish, permanently or temporarily
all or part of the content and/or the Site by any means and on any medium known or unknown to date;
- Create derivative works from the content and/or the Site;
- Modify, translate, adapt or arrange all or part of the Content and/or the Site;
- Disassemble, decompile or reverse engineer the Site.
In any event, the User is solely responsible for the use made of the Site.
Any unauthorized use of the Site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L. 335-2 et seq. of the French Intellectual Property Code.
6.2 Our trademark
The verbal and visual trademarks (logos) of the Publisher and FAUVETTE PARIS are protected. Their use without the written authorization of the Publisher or its partners on any medium, for the purpose of promoting products or services, or for commercial purposes, is prohibited under penalty of criminal and civil proceedings instituted by the Publisher against the user and/or the third party responsible.
6.3 Content
Content is freely accessible on the Site. The posting of such content does not imply any transfer of copyright or ownership of the content, which remains the full and entire intellectual property of the Publisher and the contributors.
No User may or shall take any action(s) that are incompatible with respect for copyright and intellectual property rights, or that contravene any other French or international law relating to intellectual property rights. The Publisher and its contributors reserve the right to prosecute any User for any violation of these provisions.
ARTICLE 7 - SITE MANAGEMENT
The Site is normally accessible to Users at all times. For the proper management of the Site, the Publisher may at any time reserve the right to:
- Suspend, interrupt or limit access to all or part of the Site, for any reason whatsoever, with or without notice and at its sole discretion;
- Delete any information that may disrupt the operation of the Site, for any reason whatsoever, with or without notice and at its sole discretion;
- Suspend the Site in order to carry out updates.
The Editor will do his best to inform users of the dates and times of any interventions in advance, but cannot be held liable in the event of failure to do so.
ARTICLE 8 - LIABILITY
8.1 Access to the Site
The Editor undertakes to make every effort to ensure that the Site is accessible 24 hours a day, 7 days a week. However, the Publisher makes no commitment as to the permanent availability and accessibility of the Site and does not guarantee that the Site is free from errors. The Publisher cannot be held liable for any failure, breakdown, difficulty or interruption in operation, preventing access to the Site or any of its functions.
The Editor and the host cannot be held responsible in the event of malfunction of the Internet network, telephone lines or computer and telephony equipment, in particular due to network congestion preventing access to the server.
The publisher cannot be held responsible in the event of legal proceedings against users:
- As a result of use of the Site or any other service accessible via the Internet;
- As a result of the user's failure to comply with these GTU.
8.2 Equipment used
The equipment used by the User to connect to the Site is under the User's sole responsibility. He must take all appropriate measures to protect his equipment and his own data. The User undertakes to access the Site using recent, virus-free hardware and with a recently updated browser.
The Publisher shall not be liable for any damage caused to Users, third parties and/or their equipment as a result of their connection to or use of the Site, and Users hereby waive any such claims against the Publisher.
The publisher cannot be held responsible for indirect damage (such as loss of market or loss of opportunity) resulting from use of the Site.
ARTICLE 9 - PHOTOGRAPHS
The photographs on the Site, accompanying their description, are not contractual and are not binding on the Publisher.
ARTICLE 10 - HYPERTEXT LINKS
Users are authorized to set up hypertext links to all or part of the Site, subject to prior written authorization from the Editor, requested by e-mail from the following address: contact@fauvette-paris.com.
The Publisher is free to refuse such authorization without having to justify its decision in any way whatsoever. Should the Publisher grant its authorization, it is in any case only temporary and may be withdrawn at any time, without any obligation to justify its decision. In all cases, any link must be removed on simple request from the brand.
The site contains a number of hypertext links to other sites, set up with the authorization of the Editor. However, our company is not in a position to check the content of sites visited in this way, and consequently accepts no liability in this respect.
ARTICLE 11 - PARTIAL INVALIDITY
The temporary inapplicability of one or more clauses of these terms and conditions shall not be construed as a waiver by the Publisher of its right to invoke any of said clauses.
In the event that one or more of the provisions hereof should be declared null and void or inapplicable by a law, regulation or final court decision, the other provisions shall retain their full force and scope and shall continue to apply in full.
ARTICLE 12 - LANGUAGE
In the event of translation of these terms and conditions into one or more languages, the language of interpretation shall be the French language in the event of contradiction or dispute as to the meaning of a term or provision.
ARTICLE 13 - APPLICABLE LAW
The present terms and conditions of use of the Site are governed by French law and are - in the event of a dispute - subject to the exclusive jurisdiction of the competent courts under common law, subject to a specific attribution of jurisdiction arising from a particular legal or regulatory text.
ARTICLE 14 - ASSISTANCE
The Publisher's technical team provides assistance Monday to Friday from 11 am to 5 pm, excluding public holidays. If the User is located abroad, these hours correspond to the time slot applicable in Metropolitan France.
This assistance provides the User with answers to malfunctions and anomalies encountered in using the Site. This assistance does not cover the User's needs relating to problems with his hardware or any third-party software not supplied by the Publisher.
The Publisher will not provide assistance for :
Use of the Site by the User in a manner not in accordance with these terms and conditions;
Abnormal use of the Site for any reason whatsoever;
A problem of compatibility between the Site and the User's computer equipment;
Any breach by the User of its obligations hereunder;
Unauthorized modification of the Site by the User or a third party.
In the event of failure of electronic communication networks;
In the event of a deliberate act of damage, malice or sabotage;
